- ELIGIBILITY
You must be at least 18 years old and legally capable of entering into a binding contract to purchase our services or apply for Membership.
You must provide accurate, complete and current information when submitting an enquiry, applying for Membership, making a payment or placing a Request.
You must promptly inform us if your contact details, billing information, personal circumstances or other relevant information changes.
We may refuse an enquiry, Membership application or Request where we reasonably believe that:
- the information provided is inaccurate or incomplete;
- the Request may be unlawful, unsafe, discriminatory, exploitative or inappropriate;
- the Request could expose another person to harassment, deception, coercion or harm;
- the requested deadline or budget is not reasonably achievable;
- accepting the Request would create a conflict of interest;
- payment has not been received;
- the Request falls outside the services we provide; or
- accepting the Request could damage the reputation, security or commercial interests of Secretly Lazy or a Supplier.
We are not required to disclose detailed reasons for refusing a Membership application or Request, except where required by law.
- THE NATURE OF OUR SERVICE
Secretly Lazy is a discreet romantic concierge and experience-planning service.
Depending on the service selected, we may:
- discuss your intentions, preferences and budget;
- create concepts or recommendations;
- research products, services, venues and experiences;
- source gifts or suppliers;
- make reservations or enquiries;
- coordinate logistics and delivery;
- manage an agreed Experience;
- provide reminders and occasion-planning support; and
- communicate with Suppliers on your behalf.
The exact scope of our work will be set out in the relevant Membership description, proposal, booking confirmation, invoice, Client Brief or other written communication.
Unless expressly stated otherwise, Secretly Lazy does not itself own or operate the restaurants, hotels, venues, transport services, delivery services, shops or other independent businesses used to fulfil a Request.
We will provide our own services with reasonable care and skill. However, recommendations, concepts and Experiences remain subjective, and we cannot guarantee a particular emotional reaction, relationship outcome, response from a recipient or level of personal satisfaction.
- CONSULTATIONS
A Consultation may be required before we accept a Request or Membership application.
Where a Consultation fee applies, the price will be disclosed before booking.
Unless otherwise stated in writing:
- Consultation fees are payable in advance;
- a Consultation reserves our professional time and expertise;
- a Consultation does not guarantee Membership acceptance, Supplier availability or successful completion of a Request;
- the Consultation fee does not include Supplier Costs or additional Concierge Fees; and
- the Consultation fee will not automatically be deducted from a later booking unless we confirm this in writing.
You must provide at least [24/48] hours’ notice to reschedule a Consultation.
Where you cancel with less than the required notice, fail to attend or arrive so late that the Consultation cannot reasonably proceed, the Consultation fee may be retained, subject to your statutory rights.
We may allow one rescheduled appointment at our discretion.
- MEMBERSHIP APPLICATIONS
All Membership applications are subject to acceptance by Secretly Lazy.
Submitting an application does not guarantee acceptance.
We may consider matters including:
- the type and frequency of support requested;
- whether your expectations align with our services;
- the level of service required;
- operational capacity;
- location;
- budget;
- communication requirements; and
- whether we believe we can provide an appropriate standard of service.
Membership is personal to the accepted Member and must not be shared, transferred, resold or made available to another person without our written approval.
You remain responsible for all instructions and Requests submitted through your account, email address, telephone number or other approved communication channel.
- MEMBERSHIP SERVICES
The services included in each Membership tier will be described on our website, during your Consultation, in your Membership proposal or in your welcome documentation.
Membership may include limits concerning:
- the number of Requests;
- response times;
- planning time;
- location;
- complexity;
- Supplier research;
- last-minute Requests;
- event attendance;
- out-of-hours support; and
- the value or nature of purchases that may be arranged.
Membership gives you access to the relevant Secretly Lazy concierge service. It does not mean that Supplier products, reservations, tickets, upgrades or other benefits are included in the Membership Fee unless expressly stated.
Membership does not guarantee access to any particular Supplier, event, venue, reservation, product or Experience.
Where your use materially exceeds the reasonable scope of your Membership, we may:
- charge an additional Concierge Fee;
- recommend that you upgrade your Membership;
- restrict additional Requests until current Requests are completed; or
- decline work falling outside your Membership package.
Any additional charge will be disclosed before we proceed.
- MEMBERSHIP FEES, PAYMENT AND RENEWAL
Membership Fees will be confirmed before you enter into a Membership.
Unless otherwise agreed in writing, Membership Fees are payable in advance.
Membership Fees cover access to and delivery of the relevant Secretly Lazy concierge service. Supplier Costs, product costs, reservations, tickets, delivery charges, travel expenses and additional Concierge Fees are not included unless expressly stated.
Where Membership operates as a recurring subscription, payments may be collected automatically using the payment method you authorise.
Before you enter into a recurring Membership, we will tell you:
- the price;
- the billing frequency;
- the initial Membership period;
- whether it renews automatically;
- how to cancel; and
- any applicable notice period.
You are responsible for ensuring that your payment information remains valid and that sufficient funds are available.
Where payment fails, we may suspend Membership access and pause ongoing Requests until the amount due has been paid.
We may change Membership Fees from time to time. Any change affecting an existing recurring Membership will be communicated in advance and will take effect from the next renewal date or as otherwise permitted by law.
- CANCELLING A MEMBERSHIP
Where you purchase Membership online, by telephone or away from our business premises, you may have a statutory right to cancel within 14 days beginning on the day after the Membership contract is entered into.
To exercise this right, you must notify us clearly by emailing info@secretlylazy.com.
Where you ask us to begin providing Membership services during the 14-day cancellation period, you expressly request early performance of the contract.
If you cancel after asking us to begin work, we may deduct a reasonable amount for services supplied up to the date on which you informed us of your decision to cancel.
Your cancellation rights may be affected where:
- a service has been fully performed after you expressly requested that performance begin during the cancellation period and acknowledged that you would lose your right to cancel once the service was fully performed;
- personalised or made-to-order goods have been purchased;
- bookings, reservations, tickets or services are subject to a Supplier’s non-refundable terms; or
- another statutory exception applies.
After the statutory cancellation period has ended, cancellation and refund rights will be governed by your Membership package, booking confirmation and these Terms and Conditions.
For recurring Memberships, you must cancel before the next renewal date in accordance with the notice period disclosed when you joined.
Cancellation of Membership does not automatically cancel Supplier bookings or purchases already authorised by you.
- PLACING A REQUEST
Requests may be submitted through the communication methods approved by Secretly Lazy, which may include email, telephone, website forms, an online member area or an approved messaging service.
You must provide a complete and accurate Client Brief, including:
- your intended outcome;
- the relevant date and time;
- your maximum budget;
- the location;
- the recipient’s relevant preferences;
- allergies, accessibility needs or dietary requirements;
- delivery information;
- any prohibited options; and
- any important deadlines.
You are responsible for reviewing all proposals, summaries, quotations and booking details before approving them.
We will be entitled to rely on the information and approval you provide.
Secretly Lazy will not be responsible for loss, additional cost or delay caused by inaccurate, incomplete, unclear or late instructions supplied by you.
We may ask you to confirm important instructions in writing before proceeding.
- BUDGETS, QUOTATIONS AND APPROVAL
Any initial budget indication or estimate is provisional unless expressly stated to be fixed.
Supplier prices and availability may change at any time before a booking or purchase is confirmed.
A quotation may include:
- our Concierge Fee;
- Supplier Costs;
- deposits;
- delivery or courier charges;
- travel expenses;
- taxes;
- payment-processing costs;
- handling charges;
- last-minute or rush fees; and
- contingency amounts.
We will obtain your approval before exceeding an agreed maximum budget, unless immediate action is reasonably necessary to protect an existing booking or avoid a greater loss and we are unable to contact you.
Your approval by email, text message, approved messaging platform, online account or recorded telephone instruction may be treated as authority to proceed.
Once you approve a booking or purchase, you become responsible for all agreed charges and any applicable Supplier terms.
- CONCIERGE FEES AND COMMISSIONS
Secretly Lazy may charge planning fees, consultation fees, Membership Fees, management fees, handling fees, rush fees or other disclosed Concierge Fees.
Where applicable, Secretly Lazy may also receive a commission, referral fee, partner benefit, preferred rate or commercial margin from a Supplier.
Any commission or commercial arrangement will not remove our obligation to provide our own services with reasonable care and skill.
We may recommend Suppliers with whom we have an existing commercial relationship where we reasonably consider them suitable for the Request.
Where there is a material conflict of interest that could affect our recommendation, we will take reasonable steps to disclose it.
- PAYMENT AUTHORITY
You must pay all invoices by the deadline stated.
We will not normally confirm a booking, purchase goods or instruct a Supplier until cleared funds or an agreed deposit have been received.
Where you authorise us to use a payment card or payment method to pay a Supplier on your behalf, you confirm that:
- you are authorised to use that payment method;
- sufficient funds are available;
- the payment details supplied are accurate; and
- we may use the payment method only in accordance with your approved Request.
We may use an independent payment-processing provider. We do not guarantee that any payment provider will accept a transaction.
We will not knowingly store full payment-card details unless this is handled through an appropriately secured payment system.
- THIRD-PARTY SUPPLIERS
Suppliers are independent businesses and are responsible for the products or services they supply.
A Supplier may impose its own:
- booking terms;
- cancellation policy;
- refund policy;
- admission rules;
- age restrictions;
- dress code;
- delivery terms;
- health and safety requirements; and
- privacy policy.
You agree to comply with the applicable Supplier terms.
Depending on the arrangement, the contract for the Supplier’s product or service may be:
- directly between you and the Supplier; or
- entered into by Secretly Lazy as your disclosed agent.
We will clarify the payment and contracting arrangement where reasonably necessary.
Secretly Lazy is responsible for providing its own concierge and planning services with reasonable care and skill. However, except where the law provides otherwise, we are not responsible for an independent Supplier’s acts, omissions, insolvency, closure, cancellation, delay, refusal of admission, service quality or failure to perform.
Nothing in this clause affects any legal rights you may have against the Supplier or any rights which cannot lawfully be excluded.
- AVAILABILITY AND SUBSTITUTIONS
All products, venues, bookings, tickets, accommodation, transport and Supplier services are subject to availability.
We cannot guarantee that a particular item, venue, Supplier, date, table, room, seat, performer or Experience will be available.
Where an approved option becomes unavailable, we may recommend a suitable alternative.
We will not substitute a materially different product or service without your approval, except where a minor operational substitution is reasonably necessary and does not materially reduce the quality or nature of the agreed Experience.
If you reject a proposed alternative, cancellation and refund rights will depend on whether any non-refundable costs have already been incurred.
- RESTAURANTS, VENUES, TICKETS AND RESERVATIONS
Reservations may require a deposit, minimum spend, pre-authorisation or cancellation guarantee.
You are responsible for:
- arriving on time;
- complying with the venue’s rules;
- providing correct guest numbers;
- notifying us of changes promptly; and
- paying any cancellation, no-show or late-arrival charge imposed by the Supplier.
Admission to a venue, event, restaurant, club or private premises remains at the discretion of the relevant Supplier.
